Not every dispute needs to go to court. How the Alternative Dispute Resolution Act, 2010 (Act 798) gives parties other routes.

The Alternative Dispute Resolution Act, 2010 (Act 798) provides for arbitration, mediation and customary arbitration in Ghana, and established the Alternative Dispute Resolution Centre.

Why parties choose ADR

  • Proceedings are generally private.
  • Parties can choose an arbitrator or mediator with knowledge of their industry.
  • Timetables can be agreed to suit the parties.
  • Mediation allows the parties to keep control of the outcome.

Start with the contract

Whether a dispute goes to arbitration often depends on a clause agreed long before the dispute arose. It is worth reviewing dispute resolution clauses when a contract is drafted, not when it is breached.
